Abstract

The need to strike a balance between the protection of the forest as an identity element of a landscape and the defence of its economic function and environmental profiles, has inspired the legislator’s provision of a system of derogations from the ordinary regime of landscape authorisation reserved for a range of forestry activities strictly identified and differentiated according to the different way through which the forest is subject to a landscape constraint, ex lege or ex actu, by reserving for woods bound ex actu a considerably more restrictive derogation regime. The Consolidated Law on Forests and Forest Chains follows in the footsteps of its precedents,
but while it intervenes directly with regard to activities on forests bound by law, mandates the delineation of the authorization regime of forestry activities on forests bound ex actu to future guidelines whose drafting entrusts to a synergy between Ministries involved ratione materiae. The seminar organized by CeSET was born from the need to foster a comparison between these last ones supported by experts in the matter.
